Military Cruelty and Maltreatment Cases (UCMJ Article 93)
Military cruelty and maltreatment allegations are charged under Uniform Code of Military Justice (UCMJ) Article 93. This military offense covers the following:
A military member who is cruel toward, or oppresses or maltreats, any person subject to his orders.
Victims of this offense are not just those under the direct or immediate command of the accused military member, but this also extends to all persons, subject to the UCMJ or not, who by reason of some duty are required to obey the lawful orders of the accused military member, regardless whether the accused military member is in the direct chain of command over the person. Moreover, the cruelty, oppression, or maltreatment, although not necessarily physical, must be measured by an objective standard. Assault, improper punishment, and sexual harassment may constitute this offense of maltreatment if the conduct meets the elements of this offense. Sexual harassment under this paragraph includes influencing, offering to influence, or threatening the career, pay, or job of another person in exchange for sexual favors, and deliberate or repeated offensive comments or gestures of a sexual nature. The imposition of necessary or proper duties and the exaction of their performance does not constitute this offense even though the duties are arduous or hazardous or both.
Attorney Stevens has handled multiple maltreatment cases over the years, to include claims of cruelty and maltreatment by military training instructors and drill instructors, as well as troops deployed in combat areas. Depending on the factual scenario alleged, these cases can be quite serious.
Handling these serious military cases requires the expertise of a skilled military defense lawyer. A military member accused of these offenses could face extreme jeopardy – possible federal criminal conviction, lengthy jail terms, dishonorable discharge or dismissal, and a variety of other legal, professional, personal, and family consequences.

An experienced and aggressive defense attorney is absolutely vital in these military cases.
